Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") are a legal agreement between you and Ayaan Khan, trading as Carte. ("Carte.", "we", "us") governing your use of the Carte. mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, don't use the App.
2. Who can use Carte.
You must be at least 13 years old to use Carte. Carte. is not directed at children, and we don't knowingly collect personal information from anyone under 13 — if you believe a child has given us personal information, contact us at [email protected] and we'll delete it. If you're using the App on behalf of someone else, you confirm you have the authority to accept these Terms on their behalf.
3. What Carte. does
Carte. lets you save restaurants and other places, add personal notes, tags and ratings, receive proximity-based nudges about places you've saved, get walking directions, and use "Decide for me" to get a suggestion from your own saved list. Place data (names, addresses, opening hours, photos) is sourced from Google's Places API and other third-party providers — Carte. doesn't independently verify this data, and it may be incomplete, outdated, or inaccurate. Always confirm details like opening hours directly with the venue before relying on them.
4. Your account
You're responsible for keeping your sign-in credentials secure and for all activity that happens under your account. Tell us immediately at [email protected] if you suspect unauthorised access.
5. Your content
You keep ownership of the notes, ratings, tags, and photos you add to Carte. ("Your Content"). By submitting Your Content, you grant Carte. a limited, non-exclusive licence to store, process, and display it back to you solely to operate and improve the App. We don't sell Your Content or use it to train third-party advertising models. You're responsible for making sure Your Content doesn't infringe anyone else's rights or break the law.
6. Sharing from other apps
Carte.'s share extension lets you send a link or text from apps like Instagram, TikTok, or Safari into Carte. to search for and save a place. You're responsible for only sharing content you have the right to share, and Carte. is not responsible for the accuracy of content originating from third-party platforms.
7. Carte. Premium (purchases)
Carte. Premium is available as a monthly subscription, an annual subscription, or a one-time lifetime purchase, processed through Apple's App Store and our payments partner, RevenueCat. Monthly and annual subscriptions auto-renew until cancelled — you can cancel anytime through your Apple ID account settings, and access continues until the end of the paid period. The lifetime option is a single non-recurring purchase that does not auto-renew. Refunds are handled entirely by Apple under Apple's own refund policies; Carte. cannot issue refunds directly. Pricing may change at any time for future purchasers; it does not affect purchases already made.
8. Beta / TestFlight program
If you're using Carte. through TestFlight or another pre-release channel, you're participating in a beta test. Beta builds may contain bugs, may unlock Premium features temporarily free of charge for a limited period, and may change substantially — including the removal of features — before public release. We may end your access to the beta at any time. Feedback you give us about the beta may be used to improve the App without any obligation to compensate you.
9. Acceptable use
You agree not to: reverse-engineer or decompile the App beyond what's permitted by law; use the App to harass, stalk, or endanger any person; scrape, resell, or republish place data obtained through the App at scale; interfere with or disrupt the App's infrastructure; or use the App for any unlawful purpose.
10. Third-party services
Carte. relies on third-party services — including Google (Maps, Places, Directions), Firebase (authentication and data storage), Apple (sign-in, push notifications, payments), and RevenueCat (purchase management) — to operate. Your use of the App is also subject to those providers' own terms where applicable. We're not responsible for outages, inaccuracies, or changes to these third-party services that affect the App.
11. Intellectual property
The App, its design, branding, and underlying code are owned by Carte. or its licensors and protected by intellectual property law. These Terms don't grant you any rights to Carte.'s trademarks, logos, or brand assets.
12. Disclaimer of warranties
Carte. is provided "as is" and "as available," without warranties of any kind, whether express or implied, including — to the fullest extent permitted by law — implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will be uninterrupted, error-free, or that place data (including opening hours, addresses, or availability) will be accurate or current. Nudges and reminders are provided as a convenience and may be delayed, missed, or inaccurate due to device settings, connectivity, battery optimisation, or location-service limitations — don't rely on Carte. for anything safety-critical or time-sensitive.
13. Limitation of liability
To the fullest extent permitted by law, Carte. and its team won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of — or inability to use — the App. Where liability can't be excluded by law, our total liability to you for any claim arising from these Terms or the App is limited to the greater of £10 or the amount you paid Carte. in the 12 months before the claim arose. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
14. Indemnification
You agree to indemnify and hold Carte. harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.
15. Termination
You can stop using Carte. and delete your account at any time from within the App. We may suspend or terminate your access if you breach these Terms, misuse the App, or if we discontinue the App or a feature — where practical, we'll give you reasonable notice.
16. Dispute resolution & arbitration
If you have a dispute with us, please contact [email protected] first — most issues can be resolved informally.
If we can't resolve a dispute informally within 30 days, and to the extent permitted in your jurisdiction, you and Carte. agree that the dispute will be resolved by binding, individual arbitration rather than in court, and that neither of us will bring a claim as part of a class, consolidated, or representative action. This arbitration agreement does not apply, and you retain the right to bring a claim in the courts of your own country or state of residence, if you are a consumer resident in the United Kingdom, the European Economic Area, or any other jurisdiction where a mandatory pre-dispute arbitration clause or class-action waiver is not enforceable against consumers under local law. Either party may bring an individual claim in small-claims court instead of arbitration where that court has jurisdiction.
17. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles, except where the arbitration carve-out in Section 16 gives you the right to bring a claim under the law of your own place of residence. If you're a consumer resident in the European Economic Area, this choice of law does not deprive you of the protection of any mandatory provisions of the law of your country of habitual residence.
18. Severability
If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
19. Entire agreement
These Terms, together with our Privacy Policy, make up the entire agreement between you and Carte. regarding your use of the App, and supersede any prior agreements on the same subject.
20. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, without restriction, in connection with a merger, acquisition, restructuring, or sale of some or all of our assets, or by operation of law.
21. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where required, notify you in the App. Continuing to use Carte. after changes take effect means you accept the updated Terms.
